1. Acceptance of Terms

Welcome to Clear Health Vital. By accessing or using our website located at clearhealthvital.com, our mobile applications, and our health & wellness management services, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not access or use our services. These Terms constitute a legally binding agreement between you and Clear Health Vital ("we," "us," "our"), governing your use of our services.

2. Definitions

• "Services" refers to all health & wellness management services offered by Clear Health Vital, including but not limited to general healthcare, dental care, nutrition & weight loss, hair & skin treatment, joint/bone health, cardio health, men & women healthcare, memory & neuro healthcare, and health insurance assistance.
• "User," "You," "Client" refers to any individual who accesses or uses our website or services.
• "Membership" refers to the subscription plans (Essential, Premium, Family) offered by Clear Health Vital.
• "Content" refers to all information, text, graphics, logos, and materials available on our website and services.
• "Care Team" refers to physicians, specialists, coordinators, and other healthcare professionals engaged by Clear Health Vital.

3. Services

Clear Health Vital provides premium, membership-based health & wellness management services across all 50 U.S. states. Our services include virtual and in-person consultations, personalized care plans, care coordination, prescription management, and specialized programs across nine categories of care.

• Services are provided by licensed healthcare professionals and are intended for non-emergency medical consultation and ongoing wellness management.
• Our services do not replace emergency medical care. In case of a medical emergency, call 911 or visit your nearest emergency room.
• We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.
• Specific services may not be available in all states due to licensing restrictions. We will inform you of any limitations at the time of booking.

4. Membership & Billing

By enrolling in a Clear Health Vital membership, you agree to the following billing terms:

• Membership fees are billed monthly in advance on the date of your initial subscription.
• Payment is processed automatically using the payment method provided at enrollment.
• Membership fees are non-refundable except where required by law. Unused portions of a billing cycle are not refunded.
• You may upgrade or downgrade your membership at any time; changes take effect on the next billing cycle.
• You may cancel your membership at any time by contacting us at info@clearhealthvital.com or (910) 937-0978. Cancellations take effect at the end of the current billing cycle.
• We reserve the right to change membership fees with at least 30 days' prior notice. Existing members will continue at the current rate until the next renewal.
• Certain services may incur additional fees not covered by membership (e.g., specialist procedures, lab tests). These will be disclosed before services are rendered.

5. User Responsibilities

To ensure the safe and effective delivery of our services, you agree to:

• Provide accurate, complete, and current information about your health, medical history, medications, and any other relevant details.
• Update your information promptly if any changes occur.
• Use our services only for lawful purposes and in accordance with these Terms.
• Not share your account credentials with any third party.
• Notify us immediately of any unauthorized use of your account.
• Attend scheduled appointments or provide at least 24 hours' notice for cancellations.
• Follow the care plans and instructions provided by your Care Team.
• Treat our staff, providers, and other clients with respect and courtesy.

6. Telehealth Consent

Many of our services are delivered via telehealth. By using our telehealth services, you acknowledge and agree that:

• Telehealth consultations involve the use of video, audio, and/or text-based communication technologies.
• Telehealth may have limitations compared to in-person care, including the inability to perform physical examinations.
• Your healthcare provider may determine that an in-person visit is necessary for proper diagnosis or treatment.
• You are responsible for ensuring you have the necessary technology (device, internet connection) and a private, secure location for consultations.
• Telehealth sessions are confidential and conducted over HIPAA-compliant platforms.

7. Medical Disclaimers

The information and services provided by Clear Health Vital are for general informational and wellness purposes only. They are not intended as a substitute for professional medical advice, diagnosis, or treatment.

• Never disregard professional medical advice or delay seeking it because of information provided through our services.
• Individual results may vary. We do not guarantee specific health outcomes.
• Our services are not intended for individuals under 18 without parental/guardian consent.
• Clear Health Vital is not liable for any decisions or actions taken based on information provided through our services, except as required by law.

8. Intellectual Property

All Content on our website and services, including text, graphics, logos, icons, software, and the compilation thereof, is the property of Clear Health Vital or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

If you submit reviews, testimonials, or other content to our website or services, you grant Clear Health Vital a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and display such content. If unresolved within 30 days, the dispute shall be submitted to binding arbitration administered by the American Arbitration Association in Honolulu, Hawaii, in accordance with its rules. The arbitrator's decision shall be final and binding. These Terms are governed by the laws of the State of Hawaii and the United States, without regard to conflict-of-law principles.
